1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and AI Chat Apps LLC ("Company," "we," "us," or "our") concerning your access to and use of the AI Chat 18+ iOS application and related services (collectively, the "App" or "Service").

By downloading, accessing, or using AI Chat 18+, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall the App and discontinue all use of the Service.

2. Age Requirement — Strictly 18+

2.1 Age Restriction

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to download, access, or use AI Chat 18+. This is a strictly enforced requirement due to the adult nature of the content. There are no exceptions.

2.2 Age Verification and Affirmation

By using the App, you represent, warrant, and certify under penalty of perjury that:

• You are at least 18 years of age or older
• You have reached the age of majority in your jurisdiction
• You have the legal right to access adult content in your location
• You will not permit any person under the age of 18 to access the App through your device or account
• Accessing adult and sexually explicit content is legal in your community and jurisdiction
• You are not offended by explicit sexual content and choose to view it voluntarily
• You understand the App is designed for adult sexual entertainment purposes

2.3 Parental Responsibility

If you are a parent or guardian, you are solely responsible for monitoring and restricting minors in your household from accessing adult applications. We strongly recommend using device parental controls, Screen Time restrictions, and age-restriction features available on iOS devices. We are not responsible for minors who access the App through parental negligence.

3. Nature of the Service

3.1 AI-Powered Adult Roleplay Chat

AI Chat 18+ provides AI-powered chatbot characters designed for adult roleplay scenarios, including but not limited to sexual, romantic, and intimate interactions. The Service is intended for adult entertainment and fantasy exploration.

3.2 Third-Party AI Services

Our Service utilizes third-party artificial intelligence API providers to generate text responses and images. These providers include various AI model services. By using the App, you acknowledge that:

• AI responses are generated by third-party API services, not directly by us
• We do not have complete control over AI-generated outputs
• AI content quality and availability may vary based on third-party service performance
• Third-party providers may have their own terms of service that apply

3.3 Fictional Content Disclaimer

You acknowledge and agree that:

• All AI characters are entirely fictional and not based on real individuals
• All conversations are purely fantasy and do not constitute real relationships
• The AI has no consciousness, feelings, emotions, or genuine awareness
• The Service is for entertainment purposes only
• AI-generated content may be unpredictable, inconsistent, or occasionally inappropriate
• You will not develop unhealthy attachments or confuse AI interactions with real relationships

3.4 Not a Substitute for Professional Services

AI Chat 18+ is not a substitute for professional therapy, counseling, medical advice, mental health services, or human relationships. If you are experiencing mental health concerns, relationship issues, loneliness, or require professional guidance, please consult qualified professionals.

4. Subscriptions and Image Generation

4.1 Subscription Plans

AI Chat 18+ offers optional subscription plans that provide enhanced features, including access to AI-generated image generation capabilities. All subscriptions are processed through the Apple App Store.

4.2 Image Generation Feature

Subscribers may have access to AI-generated image creation features. You acknowledge and agree that:

• Image generation is powered by third-party AI API providers
• Generated images are fictional and created by artificial intelligence
• Images do not depict real individuals unless explicitly designed to do so with consent
• We do not guarantee the quality, style, or appropriateness of generated images
• Image generation availability is subject to third-party API availability and may be interrupted
• You may not use image generation to create illegal content (see Section 5)
• Generated images are for personal use only and may not be distributed commercially

4.3 Subscription Terms

If you purchase a subscription:

• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for unused portions of subscription periods
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled

4.4 Price Changes and Refunds

We reserve the right to modify subscription prices at any time. Price changes for existing subscribers will be communicated at least 30 days in advance. Refunds may be issued through Apple. For refund requests, please contact Apple App Store support directly at reportaproblem.apple.com. We do not process refunds directly—all payment processing and refunds are handled by Apple.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use AI Chat 18+ for:

• Personal, non-commercial adult entertainment
• Consensual fantasy roleplay scenarios with AI characters
• Exploring fictional romantic or sexual scenarios in a private setting
• Generating AI images for personal, non-commercial use (subscribers only)

5.2 Strictly Prohibited Content and Conduct

You agree that you will NOT use the App or image generation feature to create, request, or engage with content involving:

• Minors: ANY content depicting, suggesting, describing, or involving individuals under 18 years of age in ANY sexual, romantic, suggestive, or inappropriate context whatsoever. This includes fictional characters described as minors, "aged-up" characters, or any content that could be interpreted as sexualized depictions of minors.
• Child Sexual Abuse Material (CSAM): Any content that constitutes or resembles CSAM under applicable law
• Non-Consent: Scenarios involving rape, sexual assault, coercion, or non-consensual acts
• Illegal Activities: Content promoting, depicting, or facilitating illegal acts under U.S. federal law, state law, or your local jurisdiction
• Extreme Violence: Graphic violence, torture, gore, or content combining violence with sexual acts
• Bestiality: Sexual content involving animals
• Incest: Sexual content between family members
• Real Persons: Creating sexual content impersonating or depicting real, identifiable individuals without their explicit consent, including celebrities, public figures, or private individuals
• Revenge Pornography: Non-consensual intimate imagery of real persons
• Harassment: Using the App or generated content to harass, threaten, stalk, or harm others
• Illegal Distribution: Sharing, distributing, selling, or publishing generated content in violation of any laws
• Deepfakes: Creating deceptive media intended to mislead others about real events or persons

5.3 Zero Tolerance Policy

We maintain a ZERO TOLERANCE POLICY for any content involving minors, child sexual abuse material (CSAM), or any illegal sexual content. Any violation will result in:

• Immediate and permanent account termination
• Reporting to the National Center for Missing & Exploited Children (NCMEC)
• Reporting to the FBI and appropriate law enforcement agencies
• Full cooperation with criminal investigations
• Preservation of all relevant data for law enforcement

5.4 Right to Ban

We reserve the right to permanently ban any user who violates our Acceptable Use Policy, including but not limited to users who attempt to create, request, or engage with prohibited content. Bans are at our sole discretion and are final. Banned users forfeit access to any remaining subscription time and are not entitled to refunds.

5.5 Content Monitoring

We reserve the right to implement automated systems and manual review processes to detect and prevent prohibited content. We may monitor, review, and remove content that violates these Terms. You consent to such monitoring as a condition of using the Service.

6. Legal Compliance

6.1 Lawful Use Only

AI Chat 18+ is designed for lawful adult entertainment. While the Service permits sexually explicit content between consenting adults, all use must comply with applicable laws. We do not condone, facilitate, or permit any illegal activity.

6.2 Your Legal Responsibility

You are solely responsible for ensuring that your use of AI Chat 18+ complies with all applicable local, state, national, and international laws and regulations. Some jurisdictions prohibit or restrict adult content, and it is your responsibility to know and follow the laws in your location.

6.3 Jurisdictional Restrictions

If adult content is illegal in your jurisdiction, you must not access or use AI Chat 18+. We are not responsible for violations of local laws by users who access the App from restricted jurisdictions. By using the Service, you confirm that adult content is legal in your location.

6.4 Cooperation with Authorities

We will cooperate fully with law enforcement agencies investigating illegal activity. We will comply with valid legal process, including subpoenas, court orders, and search warrants. We may disclose user information when required by law or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

7. AI-Generated Content Limitations

7.1 No Guarantees

AI Chat 18+ uses artificial intelligence and machine learning models from third-party providers. You acknowledge that:

• AI-generated text and images may be unpredictable, inconsistent, or unexpected
• The AI may occasionally produce errors, nonsensical content, or inappropriate outputs
• We do not guarantee the quality, coherence, accuracy, or satisfaction with AI outputs
• AI content does not represent our views, opinions, or endorsements
• Third-party API services may experience downtime or service interruptions
• Generated content may not always match your expectations or requests

7.2 User Responsibility

You are solely responsible for your interactions with AI characters, your use of generated content, and any consequences arising from such use. We are not liable for any decisions, actions, emotional responses, or harm resulting from AI-generated content.

8. Privacy and Data

Your privacy matters to us. AI Chat 18+ collects minimal data about users. We collect only anonymized analytics and usage statistics that are not linked to individuals—only to the App as a whole.

For detailed information about our data practices, please review our Privacy Policy. By using AI Chat 18+, you consent to our data collection practices as described in the Privacy Policy.

Important: We do not permanently store or share your conversation content with AI characters. Your chats are processed for response generation only and are not retained for marketing, sale, or sharing with third parties.

9. Intellectual Property

9.1 Our Intellectual Property

The App, including all content, features, functionality, software, character designs, graphics, and user interface, is owned by AI Chat Apps LLC and protected by international copyright, trademark, patent, and other intellectual property laws.

9.2 Generated Content

AI-generated text and images created through the App may be used by you for personal, non-commercial purposes only. You may not sell, license, distribute, or commercially exploit AI-generated content without our prior written consent. We retain rights in the underlying AI systems and processes that generate content.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SATISFACTORY QUALITY.

We do not warrant that:

• The App will meet your expectations or requirements
• The App will be uninterrupted, secure, or error-free
• AI responses or generated images will be accurate, appropriate, or satisfying
• Third-party API services will be continuously available
• Defects or errors will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI CHAT APPS LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Emotional distress, psychological harm, or relationship problems
• Offensive, inappropriate, or disturbing AI-generated content
• Third-party API service failures or interruptions
• Unauthorized access or data breaches
• Any conduct or content generated by the AI

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless AI Chat Apps LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

• Your violation of these Terms
• Your use or misuse of the App or generated content
• Your violation of any laws or regulations
• Your creation or distribution of prohibited content
• Any false representations regarding your age
• Your violation of any third-party rights

13. Termination

We reserve the right to suspend or terminate your access to AI Chat 18+ immediately, without prior notice or liability, for any reason, including violation of these Terms. Upon termination, your right to use the App immediately ceases, and no refunds will be provided.

You may terminate your use by deleting the App and cancelling any subscriptions through your App Store account.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, please contact us at team@aichatapps.co to attempt resolution informally.

14.2 Arbitration and Class Action Waiver

Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

15. Governing Law

These Terms shall be governed by the laws of the State of Delaware and the United States of America, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance. Continued use after changes become effective constitutes acceptance.
